Lincoln County Businessman Charged in State Tax Case

RALEIGH – A Lincoln County businessman was arrested Thursday on state tax charges filed by the North Carolina Department of Revenue.

Cecil Dean Hastings, 58, of 2380 Industrial Park Rd., Lincolnton, North Carolina was charged on December 10, 2015 with six counts of Embezzlement of State Property, and four counts of failure to file North Carolina corporate tax returns.

Arrest warrants allege that Hastings, President of Specialized Transportation, Inc., and manager of Transport Services Carolina, LLC, located in Lincolnton, aided and abetted the corporation and LLC to embezzle, misapply and convert to its own use $52,840.00 in North Carolina Withholding Tax during the period January 1, 2009 through February 2, 2015. During this period of time, Hastings was the responsible person of the corporation and LLC, which was under a duty to collect, hold in trust, and remit North Carolina Withholding Tax to the North Carolina Department of Revenue.

Additional arrest warrants allege that Hastings, as President and responsible person, aided and abetted Specialized Transportation, Inc., a North Carolina corporation, to fail to file 2009, 2010, 2011, and 2012 corporate income tax returns with the North Carolina Department of Revenue.

Hastings appeared before a Lincoln County magistrate and was placed under a $25,000 secured bond. A first appearance was scheduled for December 14, 2015 in Wake County District Court in Raleigh.

The charges against Hastings resulted from an investigation by a special agent with the Department’s Criminal Investigations Section in Raleigh.
