Edgecombe County Business Owner Charged in State Tax Case

RALEIGH – A Edgecombe County businessman was arrested Wednesday on a felony tax charge filed by the North Carolina Department of Revenue.

Tony Martin Summerlin, 58, of 275 Rollinwood Drive in Tarboro, North Carolina, was charged on April 1, 2015 with one count of Embezzlement of State Property.

The arrest warrant alleges that Summerlin, the owner of Pride Fabrication & Maintenance, LLC, aided and abetted the business to embezzle, misapply, and convert to its own use $134,690.00 in North Carolina Withholding Tax during the period October 1, 2011 through July 31, 2014. During this period of time, Summerlin was the responsible person of Pride Fabrication & Maintenance, LLC, which was under a duty to collect, hold in trust, and remit North Carolina Withholding Taxes to the North Carolina Department of Revenue.

Summerlin appeared before a Wake County magistrate and was placed under a $50,000 secured bond. A first appearance was scheduled for April 2, 2015 in Wake County District Court in Raleigh.

The charges against Summerlin resulted from an investigation by a special agent with the Department’s Criminal Investigations Section in Raleigh.
